Nigeria

This page states how these Terms operate for users whose relationship is with Cuesoft Nigeria Limited: everyone except users in the United States (see United States), and subject to the consumer protections preserved below and on the EU/UK page.

Governing law

These Terms are governed by and construed under the laws of the Federal Republic of Nigeria, without regard to conflict-of-laws principles.

Dispute resolution

  1. Negotiation first. Disputes arising out of or in connection with these Terms are first addressed by good-faith negotiation between the parties for thirty (30) days from written notice of the dispute.
  2. Arbitration. A dispute not resolved by negotiation is referred to binding arbitration before a single arbitrator under the Arbitration and Mediation Act 2023. The seat of arbitration is Lagos, Nigeria; the language is English; the arbitrator’s award is final and binding on both parties, and judgment on it may be entered in any court of competent jurisdiction.
  3. What survives for the courts. Either party may seek urgent interim or injunctive relief from a court of competent jurisdiction, and nothing here prevents proceedings to enforce an award.

Consumer protection

Nothing in these Terms limits rights you hold as a consumer under the Federal Competition and Consumer Protection Act 2018 or other mandatory Nigerian law, and nothing prevents you from complaining to the Federal Competition and Consumer Protection Commission.

Data protection

Personal data processing subject to Nigerian law is described in the Privacy Policy’s Nigeria section, under the Nigeria Data Protection Act 2023.
